These Terms of Use govern your use of the Check My Child mobile application and related services provided by Check My Child Ltd, a company registered in England and Wales (Company No. 17363145).
Please read these Terms carefully before using Check My Child. By creating an account, activating a Safety Plan or purchasing a subscription, you agree to these Terms.
1. About Check My Child
Check My Child is a child safeguarding service designed to help ensure that children who cannot call for help themselves are not left without support if their parent or sole carer becomes unable to ask for help.
The service allows a parent or carer to create a Safety Plan, nominate a trusted contact and choose a daily check-in time.
If a scheduled check-in is missed, Check My Child sends reminders to the user. If the check-in remains incomplete and the Safety Plan reaches its escalation point, an SMS alert is sent to the trusted contact nominated by the user.
Check My Child provides an additional safeguarding measure. It does not guarantee that an emergency will be detected or successfully responded to.
2. Check My Child Is Not an Emergency Service
Check My Child is not an emergency service and must not be used as a substitute for contacting the emergency services.
Check My Child does not automatically contact the police, ambulance service, fire and rescue service, NHS, social services or any other emergency or statutory service when a check-in is missed.
If you believe that you, your child or another person is in immediate danger or requires urgent assistance, you should contact the appropriate emergency service directly.
Check My Child is designed to complement, not replace, emergency, healthcare or statutory safeguarding services.
3. Your Safety Plan
You are responsible for ensuring that the information contained within your Safety Plan is accurate and kept up to date.
This includes your contact information, information about the child or children included within your Safety Plan, your nominated trusted contact and their telephone number, your chosen check-in time, and any information or instructions you choose to provide for your trusted contact.
You should update your Safety Plan whenever your circumstances or your trusted contact's details change.
4. Your Trusted Contact
You are responsible for choosing an appropriate person to act as your trusted contact and for obtaining their agreement before providing their details to Check My Child.
Your trusted contact is an independent third party. They are not an employee, agent, contractor or representative of Check My Child Ltd, and Check My Child Ltd does not control or supervise their actions.
You should ensure that your trusted contact understands what receiving a Check My Child alert means and what you would reasonably expect them to do if an alert is received.
5. Emergency SMS Alerts
When the escalation conditions of an active Safety Plan are met, Check My Child will attempt to send an SMS alert to the telephone number provided for your trusted contact.
The alert is intended to notify the trusted contact that the user has missed their scheduled safeguarding check-in so that they can take appropriate action, such as attempting to contact the user and, where appropriate, checking on the user and child.
Check My Child Ltd cannot guarantee that a trusted contact will receive, read, acknowledge or respond to an alert, or guarantee what action a trusted contact will take after receiving one.
The decision about how to respond to an alert remains with the trusted contact.
6. Technology and Communication Limitations
Check My Child relies on third-party technology and services, including internet connectivity, mobile networks, push-notification services, SMS providers, mobile operating systems and cloud infrastructure.
Although Check My Child Ltd takes reasonable steps to operate and maintain the service, electronic communications can occasionally be delayed, interrupted or fail for reasons outside our reasonable control.
This may include mobile or internet outages, SMS delivery failures or delays, incorrect or outdated telephone numbers, devices being switched off or unavailable, notification permissions or device settings, third-party service interruptions, or other circumstances outside our reasonable control.
For this reason, Check My Child should be regarded as an additional safeguarding measure rather than a guaranteed emergency-response system.
7. Your Responsibilities
You are responsible for using Check My Child appropriately and for keeping the information required for your Safety Plan accurate.
You are responsible for selecting an appropriate trusted contact, obtaining their agreement to act in that role, keeping their telephone number current, maintaining access to a compatible device and appropriate connectivity, and completing your daily check-in when you are able to do so.
You must not deliberately misuse the service or use its alert functionality for fraudulent, abusive, unlawful or misleading purposes.
8. No Guarantee of an Emergency or Safeguarding Outcome
Check My Child is designed to create an additional signal when a scheduled check-in is missed.
It cannot guarantee that every emergency or period of incapacity will be detected.
A completed check-in does not confirm a person's health, safety or location and should not be interpreted as a medical or welfare assessment.
Similarly, a missed check-in does not necessarily mean that an emergency has occurred.
Check My Child Ltd cannot guarantee that use of the service will prevent injury, harm, loss or any particular safeguarding outcome.
9. Medical Disclaimer
Check My Child is not a medical monitoring, diagnostic or treatment service.
Information entered into the app is not monitored by healthcare professionals, and Check My Child does not provide medical advice.
Users should seek appropriate professional or emergency assistance when required.
10. Subscription and Payments
Access to the Check My Child Safety Plan is offered through an auto-renewing subscription currently priced at £5.99 per month, subject to the price displayed through the relevant app store at the time of purchase.
Payment is processed by the platform through which the subscription is purchased, such as Apple's App Store or Google Play.
Subscriptions automatically renew unless cancelled in accordance with the subscription settings and terms of the relevant platform.
You can manage or cancel your subscription through your Apple or Google account subscription settings.
Subscription prices may change in the future. Where required, appropriate notice or consent will be provided in accordance with applicable law and the requirements of the relevant app store.
Nothing in these Terms affects any cancellation, refund or other statutory consumer rights you may have.
11. Service Availability
We aim to keep Check My Child available and functioning reliably, but uninterrupted availability cannot be guaranteed.
We may occasionally need to suspend or restrict parts of the service for maintenance, security, technical changes, updates or circumstances outside our reasonable control.
Where reasonably possible, we will seek to minimise disruption.
12. Changes to the Service
We may update or modify Check My Child to improve functionality, security, reliability, accessibility or compliance with legal or platform requirements.
Features may therefore change over time.
Where a material change significantly affects the service provided under a paid subscription, we will take reasonable steps to inform affected users where appropriate.
13. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful or affects your statutory rights as a consumer.
Check My Child Ltd is responsible for providing its service with the standard required by applicable law.
However, to the extent permitted by law, Check My Child Ltd is not responsible for the independent acts or omissions of a user's nominated trusted contact or another third party whom Check My Child Ltd does not control.
In particular, Check My Child Ltd cannot guarantee that a nominated trusted contact will respond to an alert, attend the user's location, contact emergency services or take any particular action.
We are also not responsible for failures caused solely by circumstances outside our reasonable control, subject always to the rights and protections you have under applicable law.
Nothing in these Terms is intended to exclude or restrict liability where doing so would be unlawful.
14. Privacy and Personal Information
Check My Child processes personal information in accordance with our Privacy Policy.
Safety Plans may contain information relating to children and trusted contacts. Users should only provide information that is relevant to the operation of their Safety Plan.
Please read our Privacy Policy for information about the personal information we collect, why we collect it, how it is handled and your data-protection rights.
15. Account Security
You are responsible for taking reasonable steps to protect access to your Check My Child account and your device.
You must not knowingly allow another person to misuse your account or use the service for fraudulent, unlawful or abusive purposes.
Please contact us if you believe your account or account credentials have been compromised.
16. Suspension or Termination
We may restrict or suspend access to Check My Child where reasonably necessary, including where we reasonably believe that the service is being deliberately misused, an account is being used fraudulently or unlawfully, continued use creates a security risk, or suspension is necessary to comply with a legal or regulatory obligation.
Where appropriate and reasonably possible, we will explain the reason for the restriction.
17. Intellectual Property
The Check My Child name, branding, software, design, written content and other intellectual property associated with the service belong to Check My Child Ltd or its applicable licensors.
Using Check My Child does not transfer ownership of this intellectual property to you.
You may not copy, reproduce, modify, distribute or commercially exploit the service except where permitted by law.
18. Children's Use of Check My Child
Check My Child is intended to be set up and managed by an appropriate adult.
The service is designed to help safeguard children who may be unable to independently call for help.
Check My Child does not place responsibility on a child to monitor or respond to the wellbeing of their parent or carer.
19. Changes to These Terms
We may update these Terms from time to time, including because of changes to Check My Child, applicable law or app-store requirements.
The latest version will be published on the Check My Child website and will show the date on which it was last updated.
Where a change materially affects users' rights or obligations, we will provide appropriate notice where required.
20. Governing Law
These Terms are governed by the applicable laws of England and Wales.
Nothing in these Terms deprives a consumer living elsewhere in the United Kingdom of any mandatory legal protections or rights that apply to them.
